Artist Fabian Perez and defendant submitted a third party claim arguing that Perez art - limited edition prints never belonged to defendant Bane. The district cout denied this third party claim. Bane has appealed both decisions notwithstanding his admission that his company sold Sorayama art without permission, used the money for his own purposes, has owed Sorayama a six figure sum since 2001 and performed unlawfully regarding original arts of the artist as early as 1998.
